Directive: Addressing Excessive Demands for Certified True Copies in Administrative Procedures
On November 30, 2024, the Government Office issued Official Letter No. 8835/VPCP-KSTT to address excessive demands for certified true copies in administrative procedures.
Directive: Addressing Excessive Demands for Certified True Copies in Administrative Procedures
Under Official Letter No. 8835/VPCP-KSTT of 2024, Deputy Prime Minister Le Thanh Long requested that relevant entities focus on the following tasks to address excessive demands for certified true copies in administrative procedures:
(1) Ministries, ministerial-level agencies, and People’s Committees of provinces and centrally governed cities:
– Instruct subordinate agencies and organizations to strictly implement the Government’s Decree No. 23/2015/NĐ-CP on issuing copies from master registers, certifying true copies of originals, authenticating signatures, and certifying contracts and transactions. Ensure that, when applications for administrative procedures are received, organizations and individuals may choose to submit copies of papers and documents and present the originals for comparison (when submitting applications or collecting the results of administrative procedures). Staff receiving applications must check and compare the copies themselves and take responsibility for their accuracy against the originals, without requiring organizations or individuals to submit copies issued from master registers or certified copies.
Inspect implementation to promptly identify and address excessive demands for the submission of papers and documents (including certified copies) that are inconsistent with regulations.
– Direct subordinate agencies and organizations to accelerate the implementation of electronic administrative procedures under the Government’s Decree No. 45/2020/NĐ-CP on conducting administrative procedures electronically; increase the acceptance and use of electronic copies in processing administrative procedures; accelerate the digitization of applications and results of administrative procedures; and deliver the results of administrative procedures electronically. Step up communications so that organizations and individuals are aware of and request certification of electronic copies of originals in accordance with Decree No. 45/2020/NĐ-CP.
(2) Ministries and ministerial-level agencies:
– Urgently develop and upgrade national and specialized databases under their assigned management authority and connect them to provincial information systems for processing administrative procedures to enable data sharing and reuse in processing administrative procedures.
– Continue reviewing normative legal documents within their management remit that prescribe administrative procedures requiring the submission or presentation of certified papers and documents, and amend or supplement them, or recommend amendments or supplements, with the following aims: minimize requirements to submit or present certified papers and documents; require state agencies to access information in the National Population Database, national databases, and specialized databases, and through the National Digital Identity Application, and to use applications and results of administrative procedures that have been digitized and issued electronically instead of requiring paper submissions when conducting administrative procedures.
The Government Office hereby notifies the agencies for their information and action.
