Amendments and Additions to Eligible Vietnamese and Foreign Participants in Educational Partnerships

On October 5, 2024, the Government issued Decree 124/2024/NĐ-CP, amending and supplementing several articles of Decree 86/2018/NĐ-CP on foreign cooperation and investment in education.

Accordingly, Decree 124/2024/NĐ-CP amended and supplemented the provisions on eligible Vietnamese and foreign participants in educational partnerships as follows:

– Vietnamese participants: Private preschool and general education institutions established and operating in Vietnam, funded by domestic investors who ensure that the institutions meet the conditions for operation.

– Foreign participants:

+ Educational institutions legally established and operating abroad that have operated abroad for at least five years as of the application submission date without violating the host country’s laws during their operation, provide in-person instruction, and hold a valid certificate of educational quality accreditation or have their educational quality recognized by a competent foreign education authority or organization;

+ Organizations providing educational programs that are legally established and operating abroad and have provided preschool or general education programs for at least five years as of the date of submission of the application to implement an educational partnership.

(Currently, Decree 86/2018/NĐ-CP specifies only Vietnamese private preschool and general education institutions and educational institutions legally operating abroad whose educational quality is recognized by an educational quality accreditation agency or organization or a competent foreign authority.)

Regulations on Foreign Academic Programs Delivered in Vietnam

Also under Decree 124/2024/NĐ-CP, foreign academic programs delivered in Vietnam must meet the following requirements:

– Be academic programs offered by foreign higher education institutions and either approved for delivery and degree issuance by the competent authority in the institutions’ home country or covered by a valid certificate of quality accreditation issued by a legally operating quality accreditation organization;

– Contain no content detrimental to national defense, national security, or community interests; not propagate religion or distort history; and not adversely affect Vietnam’s culture, ethics, or fine customs and traditions.

(Currently, Decree 86/2018/NĐ-CP stipulates that foreign academic programs delivered in Vietnam must have received educational quality accreditation in their home country or have their educational quality recognized by the competent education authority in that country; contain no content detrimental to national defense, national security, or community interests; not propagate religion or distort history; not adversely affect Vietnam’s culture, ethics, or fine customs and traditions; and ensure the conditions for transfer programs between levels of education.)
