Decree 98/2023/NĐ-CP will apply to Vietnamese individuals, state agencies, political organizations, socio-political organizations, socio-political-professional organizations, social organizations, socio-professional organizations, enterprises, other economic organizations, units of the people’s armed forces, and households; overseas Vietnamese individuals and collectives; foreign individuals and collectives; and foreign agencies and organizations and international organizations in Vietnam.

In addition, consideration for emulation titles and forms of commendation from January 1, 2024, will follow these principles:

– Commendations must be based on eligibility requirements, criteria, and achievements. A lower-level commendation is not necessarily required before a higher-level commendation can be awarded.

– Competent authorities shall award emulation titles and forms of commendation, or recommend that higher authorities do so, for cases that meet the prescribed eligibility requirements, criteria, procedures, and documentation requirements.

– Commendations for exceptional achievements or achievements in thematic emulation campaigns shall not serve as a basis for recommending that higher authorities award commendations for meritorious service.

– No commendation shall be awarded or recommended to higher authorities for individuals or collectives while competent agencies are considering disciplinary action or conducting investigations, inspections, or examinations in response to signs of violations or written complaints or denunciations, or while issues of corruption or misconduct reported by the press are being verified and clarified.

For individuals or collectives subject to disciplinary action who attain achievements after completing the disciplinary period, achievements eligible for commendation shall be counted from the date that period ends.

– Statutory maternity leave shall count toward consideration for emulation titles and forms of commendation for individuals.

– When multiple individuals or collectives meet the same eligibility requirements and criteria, female individuals or collectives with a female membership of 70% or more shall be selected for consideration for commendation.

– The length of tenure required for female leaders and managers to be considered for commendations for their service contributions shall be reduced by one-third compared with the general requirement. For female leaders and managers subject to a higher statutory retirement age, the required tenure for consideration for such commendations shall follow the general requirement.
