Guidance on Salary Placement for Administrative Public Employees Recruited on or After December 7, 2023

Ministry of Home Affairs Issues Circular 05/2024/TT-BNV Providing Guidance on Salary Placement for Administrative Public Employees Recruited on or After December 7, 2023.

On June 27, 2024, the Minister of Home Affairs issued Circular 05/2024/TT-BNV prescribing standards and conditions for consideration for promotion to Grade II and Grade I for administrative public employees, clerical public employees, and archival public employees; and salary placement for persons recruited or accepted into public employment.

Accordingly, salary placement for administrative public employees recruited on or after December 7, 2023, is regulated as follows:

(1) For persons currently paid under state-prescribed salary schedules, salary placement upon recruitment or acceptance into public employment is determined for each case as follows:

– Persons currently paid under the professional and technical salary schedules for civil servants or public employees prescribed in Decree 204/2004/NĐ-CP (as amended and supplemented by Decree 76/2009/NĐ-CP, Decree 17/2013/NĐ-CP, and Decree 117/2016/NĐ-CP) shall follow the guidance in Clause 2, Section II of Circular 02/2007/TT-BNV on salary placement upon promotion to a higher rank, transfer between ranks, or change of category for civil servants and public employees;

– Persons currently paid under the rank-based salary schedules for officers of the People’s Army; officers and noncommissioned officers of the People’s Public Security Forces and the cryptographic service; the salary schedules for professional military personnel of the People’s Army and technical specialists of the People’s Public Security Forces; or the salary schedules for cryptographic personnel shall follow the guidance in Clauses 6 and 7, Section III of Circular 79/2005/TT-BNV on salary conversion and placement for cadres, civil servants, and public employees changing jobs, and for persons transferred from the armed forces, the cryptographic service, and state-owned companies to state agencies and state public service units;

– Persons holding titles or positions at state-owned enterprises who are paid according to the salary coefficients for full-time company managers prescribed in Decree 52/2016/NĐ-CP on salaries, remuneration, and bonuses for managers of single-member limited liability companies in which the State holds 100% of the charter capital shall follow the guidance in Circular 13/2018/TT-BNV amending Clause 8, Section III of Circular 79/2005/TT-BNV.

(2) For persons previously paid under state-prescribed salary schedules who subsequently moved to the private sector (and have not received a lump-sum social insurance benefit) and have periods of employment with compulsory social insurance contributions, salary placement upon recruitment or acceptance into public employment is determined for each case as follows:

Salary conversion and placement under (1) shall be based on the salary coefficient at the time of moving to the private sector. For employment periods with compulsory social insurance contributions after moving to the private sector, persons appointed to public employee titles with salary placement in category A0 or above shall advance one salary step or receive a seniority allowance beyond the highest salary step (if applicable) for every three years (a full 36 months); those appointed to public employee titles with salary placement in category B shall do so for every two years (a full 24 months). Any remaining months totaling fewer than 36 months (for public employees with salary placement in category A0 or above) or fewer than 24 months (for public employees with salary placement in category B) shall count toward the period for consideration for the next salary step increase or a seniority allowance beyond the highest salary step (if applicable).

(3) For persons with periods of salaried employment involving compulsory social insurance contributions in accordance with the law who do not fall under (1) or (2), salary placement and determination of the equivalent period of holding the public employee grade to which they are appointed upon recruitment or acceptance shall be carried out as follows:

– Salary placement:

The total period of salaried employment involving compulsory social insurance contributions shall be calculated (nonconsecutive periods shall be added together if no lump-sum social insurance benefit has been received), less the probationary period prescribed for the professional title to which the person is appointed upon recruitment or acceptance. The remaining period shall serve as the basis for salary placement in the professional title for which the person is recruited or accepted, as follows:

Starting from step 1 of the public employee professional title to which the person is appointed upon recruitment or acceptance, persons appointed to public employee titles with salary placement in category A0 or A1 shall advance one salary step for every three years (a full 36 months), while those appointed to public employee titles with salary placement in category B shall advance one salary step for every two years (a full 24 months).

After the employment period has been converted into salary steps within the professional title to which the person is appointed upon recruitment or acceptance as described above, any remaining months totaling fewer than 36 months (for public employees with salary placement in category A0 or A1) or fewer than 24 months (for public employees with salary placement in category B) shall count toward the period for consideration for the next salary step increase or a seniority allowance beyond the highest salary step (if applicable) within that title.

– Determination of the equivalent period of holding the public employee grade to which the person is appointed upon recruitment or acceptance:

Where periods of salaried employment involving compulsory social insurance contributions in accordance with the law are counted toward salary placement in the public employee grade to which the person is appointed upon recruitment or acceptance under (3), the equivalent period of holding that grade shall be calculated from the date on which the person attained an educational qualification at or above the level required for the job position for which they are recruited or accepted.

(4) For persons recruited or accepted into public employment and assigned salaries under (1) or (2), if their prior employment included a year in which their performance was assessed and rated as failing to fulfill duties, or in which they were disciplined, but their waiting period for a salary step increase has not been extended as prescribed, the period excluded from salary placement calculations shall be determined under Clause 3, Article 2 of Circular 08/2013/TT-BNV guiding the implementation of regular and early salary step increases for cadres, civil servants, public employees, and workers (as amended by Clause 5, Article 1 of Circular 03/2021/TT-BNV).

Note: Where the acceptance or recruitment decision is issued on or after December 7, 2023, the salary entitlement period and the period for consideration for the next salary step increase shall be calculated from the date of the salary placement decision issued by the competent authority upon recruitment or acceptance. Salary placement under Circular 05/2024/TT-BNV does not apply to existing public employees being considered for transfer between professional title grades under specialized legislation.

Circular 05/2024/TT-BNV takes effect on August 15, 2024.
